Mary Cummins sues Bat World Sanctuary, Amanda Lollar, Rebecca Dmytryk, Eric Shupps, Tiffany Krog, Annette Stark for defamation

September 27, 2012 Judge Dolly Gee granted Plaintiff Mary Cummins’ Motion for Leave to file her Second Amended Complaint to add the now known John Doe Defendants. Subpoenas sent to Google, YouTube and Blogger revealed the identities of the John Does. The newly named Defendants are Rebecca Dmytryk of WildRescue, Eric Shupps of BinaryWave, Tiffany Krog an attorney with DiJulio Law and Annette Stark a writer for LA Weekly, (out of business) LA City Beat and wife of Richie Ramone ex-drummer with the Ramones.

Cummins stated “I sent cease and desist letters to these people asking them to please remove their defamation but they refused. I probably won’t be able to get a monetary award because most of them are penniless. Rebecca Dmytryk of WildRescue and Eric Shupps of BinaryWave in fact recently went bankrupt. I filed this suit to get their defamation removed.”

Defendants posted that Plaintiff Cummins “has a criminal record,” was “convicted” of “theft of property, forged name on credit card,” is a “cyberstalker,” “cybersquatter,” was “picked up by police,” “hacked into our website” and “email list,” was “picked up by the LAPD anti-terrorism task force,”
“posts pornography in children’s chat rooms,” “commits animal cruelty,” “tortures animals” is a “whore” besides many other horrible things which are far too obscene and revolting to post.

Cummins added “I have never been charged with or convicted of a crime in my entire life. What they  posted is libel per se.”

Mary Cummins of Animal Advocates is a wildlife rehabilitator licensed by the California Department of Fish and Game and the USDA. Mary Cummins is also a licensed real estate appraiser in Los Angeles, California.

Cummins speaks to local community groups and students about respecting wildlife and humane wildlife control. She is also a Humane Nuisance Wildlife Control Operator. She has written manuals on small mammal rehabilitation besides numerous articles. She was born and raised in Southern California. She attended Beverly Hills Good Shepherd Catholic School and Beverly Hills High School. Besides being a member of Junior Mensa and on the Dean's list, she was a top ten national swimmer and competed on the men's water polo team. She began college at the age of 15 attending the University of Southern California on scholarship, majoring in Psychology/Sociology. After college Cummins became a licensed real estate agent specializing in income property in Los Angeles. She obtained her real estate appraisal license, real estate brokerage license and currently does real estate consulting, expert witness testimony and review appraisals at Cummins Real Estate Services.
